1. Scope of Services
Joule.email provides business-to-business (B2B) marketing solutions, which may include:
Email content sponsorship
Data profiling, supply, and verification
Custom email campaign design and delivery
Microsite or landing page creation
Contact engagement analytics and reporting
Compliance-related services (e.g. GDPR and PECR guidance)
All services are delivered under agreement with the client and are for commercial use only. Joule.email does not provide services to individuals for personal, non-business use.
2. Data Usage & Compliance
Joule.email only processes business contact data and operates in accordance with the EU General Data Protection Regulation (GDPR), UK GDPR, and the Privacy and Electronic Communications Regulations (PECR) where applicable.
Clients are responsible for ensuring their use of data provided by Joule.email complies with all applicable laws in their jurisdiction, including but not limited to:
Sending lawful B2B communications
Honoring opt-out and unsubscribe requests
Using provided data only for agreed campaign or marketing purposes
Joule.email reserves the right to suspend or terminate service if there is evidence of misuse of data or breach of legal obligations.
3. Client Responsibilities
Clients using Joule.email services agree to:
Provide accurate and lawful instructions
Review and approve campaign materials before launch
Ensure the content they supply (copy, creative, links) complies with applicable advertising standards and laws
Not use our services to send unsolicited communications outside of the B2B context
Respect the intellectual property of Joule.email and third parties
Any delays or inaccuracies resulting from incomplete or inaccurate information supplied by the client will not be the responsibility of Joule.email.
4. Intellectual Property & Ownership
All materials created by Joule.email—including designs, layouts, reports, microsites, and verified data outputs—remain the intellectual property of Joule AI Sp. z o.o. unless otherwise agreed in writing.
Clients are granted a non-exclusive, non-transferable license to use the deliverables strictly for internal business and marketing purposes, in accordance with the agreed scope.
Use of our brand, trademarks, or proprietary methods without permission is prohibited.
5. Limitation of Liability & Termination
Joule.email will not be liable for:
Loss of profit, revenue, or data
Indirect or consequential damages
Results based on third-party platforms, services, or audience behavior beyond our control
In all cases, Joule.email’s liability will be limited to the total amount paid by the client for the specific service that gave rise to the claim.
We reserve the right to terminate access to our services if clients breach these terms, misuse our data or tools, or act in a way that harms our reputation or legal standing.
Governing Law
These Terms shall be governed by the laws of Poland. Any disputes will be subject to the exclusive jurisdiction of the courts in Warsaw.
